Tampa Property Division Lawyer

How Will the Property Be Divided?

Whether you are exiting a short-term marriage or a long-term relationship, untangling the marital assets can be complicated. At Mark S. Howard, P.A., we have experience with complex property division during divorce. Mark Howard is an AV* rated lawyer and Tampa property division attorney who is a skilled litigator.

At our law firm we help our clients stay focused on the net result. There is some property that may have an extreme emotional attachment — a piece of artwork for example. There is other property that may simply be a liquid asset which can be liquidated and the proceeds split — a certificate of deposit, cash savings or stocks for example.

Florida law states that marital assets should be divided equitably, which is not the same as 50-50. What is equitable will depend upon the current and anticipated income of each party, the valuation of the assets and other factors.

Complex Marital Property Issues

For some couples, the assets can be listed on a yellow pad and divided amicably. For other couples it is more complicated. At our law firm we have experience with highly complicated property issues and high asset divorce including the following issues:

  • Business valuation of closely held corporations, LLCs, PLLCs and family partnerships
  • Tax consequences
  • Inheritance issues and the affects upon future heirs
  • Valuation of art or other types of collections
  • Offshore or foreign investments
  • Forensic accounting
  • Stocks, bonds and securities
  • Delayed executive compensation
  • 401(k) and other retirement funds

Tampa/St. Petersburg Asset Distribution Attorney for Real Estate Holdings

Real estate holdings are not as liquid as some other assets, and so their value and liquidation may be more complicated. For example, a primary residence may be underwater, or have significantly less value compared to five years ago. How is that considered during the division of property? We can help you with these determinations and any of the following issues:

  • Real estate division of primary residence and equity
  • Division or liquidation of vacation property
  • Valuation and division of commercial real estate property
  • Valuation and division of foreign real estate property
  • Valuation of time shares or condominium real estate holdings
